California Gov. Gavin Newsom has recently proposed new regulations to ban THC-containing hemp products on an emergency basis to help protect younger Californians from unregulated THC.

Newsom shared the news of his proposal in a statement this week. In it, he said the ban is meant to ensure safety is being given the highest priority.

“We will not sit on our hands as drug peddlers target our children with dangerous and unregulated hemp products containing THC at our retail stores,” Newsom said. “We’re taking action to close loopholes and increase enforcement to prevent children from accessing these dangerous hemp and cannabis products.”

The regulations being proposed by the California Department of Public Health will require industrial hemp food, beverage, and dietary products meant for human consumption to have zero detectable amounts of THC per serving.

The regulations would also raise the minimum age to purchase hemp products to 21 and limit the number of servings of hemp products to five per package.

Once the regulations are approved by the Office of Administrative Law, they will go into effect immediately, with the California Department of Alcoholic Beverage Control enforcing compliance.

Sellers will then be required to implement purchase restrictions and remove products from their shelves that have THC.

CDPH Director Tomás Aragón shared in the statement that the new regulations seek to protect California consumers from “intoxicating industrial hemp products” that can “cause illness and injury.”

“We are working to ensure products in the marketplace comply with state laws that protect consumers against these public health risks and have proposed emergency regulations that will improve protections for consumers,” Aragón said.

The move from Newsom is major, as California has always been at the forefront of the weed movement. The state became the first to allow medicinal cannabis use in 1996 when voters passed the Compassionate Use Act. They then voted again in 2016 to legalize recreational use of cannabis.
