COLORADO SPRINGS, Colo. (KKTV) – In just a few days Colorado Springs may know whether a ballot measure on recreational marijuana will be allowed to stand. The city is facing a lawsuit over it after the council voted to ask voters to repeal a decision made in the fall, to allow local sales.

“I‘m pretty hopeful we have a pretty good decision here come Monday obviously the judge is under a pretty tight timeframe,” president of the Colorado Springs Cannabis Association Tom Scudder said.

Friday afternoon a packed courtroom heard arguments from both sides over a controversial ballot measure.

“We think it really is a possibility that there is confusion,” City Council member Dave Donelson said the day city council voted in favor of a ballot measure to repeal Question 300 which voters approved in the fall.

300 permitted already-established medical dispensaries to sell recreational marijuana, starting this spring. Some city council members believe voters were confused.

Now, a lawsuit brought by two men claims the city council is trying to put a prohibition on recreational marijuana in the city, by repealing the voters’ decision on question three hundred. Additionally, they believe it is against the Colorado constitution.

“The citizens have already voted on it and it’s already been passed,” plaintiff Renze Waddington said.

11 News reached out to the city they say, they don’t comment on pending litigation, but in court, city attorneys say if the judge’s decision doesn’t go in their favor they’ll appeal to the state supreme court.

The judge says she will have a ruling by Monday at 5 p.m.
