The embargo affects nearly 200 individual products manufactured or distributed by K.U.S.H.

The California Department of Cannabis Control revoked the license of K.U.S.H. Collective for engaging in “activity that poses harm to public health, safety or welfare,” the agency said in a letter to the company’s owners.

The license revocation is effective as of Oct. 15.

In addition, the DCC issued an embargo for all products manufactured by K.U.S.H., a list that includes 194 individual vaporizer or vape cartridge products produced under 12 brand names. Brands affected include:

“DCC has probable cause to believe the products included in this notice of embargo may be adulterated or misbranded, posing a potential risk to consumers,” the agency said in the formal announcement of the embargo.

In a letter to Jimmy Shin and David Shin, who were listed as the company’s owners on the license, the department referenced an Aug. 30 on-site inspection in which “staff observed 2.8 pounds of cannabis flower and 52.48 pounds of 1g Cloud vape cartridges,” none of which had the required unique identifier package tags attached, rendering them untraceable by the state’s tracking system.

The letters also cited other violations.

An investigation undertaken by the Los Angeles Times and WeedWeek earlier this year found that many of the products sold under the Backpack Boyz brand tested positive for pesticide contamination.

The DCC previously issued a mandatory recall on Sept. 6 for several vape cartridges manufactured and distributed by K.U.S.H. for “contamination with the pesticide Chlorfenapyr at levels exceeding the action level,” the letter noted.

Recalls are not uncommon in the California cannabis industry, with more than 50 issued by the DCC since 2022. This is the first embargo alert in that timeframe. Products that are under embargo cannot be sold, distributed, disposed of or removed from their locations without written authorization from the DCC.

The department lists 36 license revocations for cannabis operators so far in 2024.
