OXFORD, Miss. – Two Oxford business owners are in trouble with the law, both accused of selling products that exceed the legal limit for THC. FOX13 spoke with one of the owners, who told us his products are legal.

Antonio Barragan runs a CBD shop and medical cannabis dispensary in Oxford. He says law enforcement conducted an undercover sting to test his products. According to reports, those products came back over the legal limit, but Barragan says he’s not at fault.

“As soon as I walked into the dispensary, they put me in handcuffs, told me I was under arrest.”

Barragan was taken into custody Monday on charges linked to violations of the Mississippi Medical Cannabis Act. He says his store was raided by law enforcement, accusing him of selling products that are in violation of the law.

“They had a year and a half investigation, had a search warrant for my business and for my home,” Barragan explained. “They purchased products out of my store four times and sent them to testing.”

In Mississippi, THCA is legal only if THC levels are below a 0.3% threshold. Barragan says his product labels read 0.3%, but says law enforcement informed them that when they tested his products during the investigation, the product tested higher than the legal limit.

Barragan told FOX13 he believes he’s gone through the appropriate protocols. He says oftentimes, outdoor temperatures can impact the product during shipping by altering THC content, causing THC levels to spike up.

“These products are able to be shipped legally for us to be able to sell them. So, we do our due diligence by verifying that testing facilities did actually test the specific product from the company we’re about to purchase from and that’s as far as we can go.”

Barragan’s warrant shows he’s charged with conspiracy to commit a crime, sale of medical cannabis, and manufacture and sale of a controlled substance.

“I think that they’re trying to prove a point. I think they want THCA out of the city, out of the community.”

Barragan told us he’s used his manufacturers for the past 7 years and trusts them.
