A 43-year-old Lancaster County man was arrested and charged with several felony offenses after police said he provided a 13-year-old girl with marijuana and sexually assaulted her last year.
The victim told her parents she was sexually assaulted by Robert Fink Jr., of Columbia, at his apartment on Sept. 9, 2023. The girl’s parents took her to speak with Columbia Borough Police the next day.
During the police interview, the victim said Fink’s girlfriend left the apartment around 8 p.m. and she and Fink went to his bedroom to hang out, where he provided her with marijuana that made her feel “very high,” according to an affidavit.
After smoking the marijuana, the victim said Fink started to massage her body before he locked the door and performed sex acts on her, police said.
During the abuse, Fink asked the victim, “Is this OK?” To which she responded, “No,” the affidavit said.
Fink then removed his pants and underwear, asked the victim if he was “decent enough” while referring to his genitals, and sexually assaulted her, according to the affidavit.
The 13-year-old was taken to Penn State Health Lancaster Medical Center for a Sexual Forensic Examination (SAFE). The test kit was taken to a Pennsylvania State Police laboratory on Sept. 11, 2023.
The SAFE kit’s lab results came back on March 29, 2024, but the report noted the DNA collected was from an unknown individual, police said. Investigators served a search warrant on Aug. 27 and received a mouth swab from Fink, which was sent to the PSP lab for comparison.
On Oct. 24, the PSP lab confirmed Fink’s DNA matched the samples collected with the SAFE kit, police said.
Based on the DNA evidence, police charged Fink with statutory sexual assault — 11 years or older, involuntary deviate sexual intercourse with a person less than 16 years of age, unlawful contact with a minor, sexual assault, aggravated indecent assault, corruption of minors and indecent assault of a person less than 16.
Fink, who is incarcerated in the Lancaster County Prison as of Thursday, had his bail set at $500,000. A preliminary hearing is scheduled for Nov. 19.
