Legislation that sought to ban young adults from accessing most state-legal marijuana products is dead for the session. Members of the Senate Business, Labor and Technology Committee voted unanimously to reject the bill after its sponsors acknowledged that they had received significant pushback from constituents and businesses.
Senate Bill 76 limited the sale of cannabis products with more than ten percent THC to those ages 21 to 25. It further sought to impose new restrictions on the amount of THC available per serving and per package for all consumers.
NORML opposed the measure, stating in an action alert: “Prohibiting young adults from accessing these products from state-licensed retailers doesn’t eliminate consumers’ demand for them. Rather, it encourages consumers to seek out higher-THC products from the unregulated market. This undermines the primary goal of legalization, which is to provide consumers with safe, above-ground access to lab-tested products of known purity, potency, and quality.”
NORML’s action alert was shared with lawmakers over 500 times.
The bill marked the second legislative effort in Colorado in recent years to impose arbitrary THC potency limits on adult-use cannabis products. A prior bill resulted in the convening of a state-sponsored study group, which failed to find strong evidence that higher-THC products posed any unique threats to public health.
Separate legislation to impose THC potency limits on state-regulated marijuana products is pending in Connecticut, New Jersey, and New York. Similar legislation in Montana seeking to prohibit the sale of adult-use marijuana products above 15 percent THC was recently tabled by lawmakers after an outpouring of testimony from constituent and cannabis-related business owners.
