TOLEDO, Ohio (WTVG) – A Toledo Police officer is facing a criminal charge for allegedly buying marijuana while in uniform and while driving his Toledo Police vehicle.

Officer Jeremy Berndt faces a misdemeanor charge of Dereliction of Duty in Toledo Municipal Court. It was filed Thursday.

According to court documents, Officer Berndt was observed on video purchasing marijuana while on duty on December 3rd. The affidavit says officer Berndt was wearing his police issued uniform and firearm and arrived and left in his marked Toledo Police vehicle.

The affidavit says officer Berndt bought the marijuana from Maximum Performance Cycles on Laskey Road. The report says Maximum Performance Cycle is not a state licensed marijuana dispensary.

Court records show officer Berndt has a court appearance on January 31st.

When asked for an interview or comment Friday, a Toledo Police Department spokesman said: “There is an ongoing internal investigation into this incident; therefore, per collective bargaining agreements, we are unable to interview at this time.”
