An Arkansas medical-marijuana license applicant can’t advance a race-discrimination lawsuit against the private contractor that scored its application, a federal appeals court ruled Friday.

The applicant, Absolute Essence LLC, didn’t plausibly allege that the contractor, Public Consulting Group LLC, acted with discriminatory intent when it scored the applications, a requirement for stating a race-discrimination claim under the Arkansas Civil Rights Act, the equal protection clause, or federal civil-rights laws, the US Court of Appeals for the Eighth Circuit said.
