NASHVILLE, Tenn. (WSMV) – Officers with the Metro Nashville Police Department (MNPD) discovered a large amount of marijuana and edibles after a person refused to pick up litter, according to an arrest affidavit.

The report said officers were conducting extra patrols on Dec. 27 just before 2 a.m. at a gas station in the 200 block of West Trinity Lane when they saw a man pumping gas throw something on the ground in the parking lot.

Police advised the suspect, later identified as David Martin, to pick up what he had reportedly thrown on the ground, but Martin just looked at the officers and ignored the command. He then began to make his way to the driver seat of his car when police asked him to pick up the item again or he would receive a citation.

Martin reportedly ignored the command again and police approached, the report said.

When police made contact with Martin, they ran his information. They discovered that he had previously been charged with felon in possession of a handgun in 2023 and was currently on felony probation.

Due to Martin’s probation status, police searched his vehicle. That search produced a loaded handgun, 63 grams of marijuana, and 61 packages containing edibles. The number of edibles located totaled 3,584.5 grams.

Before police searched the car, Martin told them they would only find edibles.

Martin was arrested and charged with possession with intent to sell a schedule 4 substance and felon in possession of a weapon.

Martin was booked into the Davidson County Jail on a $85,000 total bond.
