LINCOLN, Neb. (KLKN) – Gov. Jim Pillen on Thursday signed two proclamations that certified the enactment of Nebraska’s medical marijuana initiatives.
Initiative Measure 437 legalizes medicinal cannabis.
Initiative 438 establishes a commission to regulate medical marijuana.
Both the governor and Attorney General Mike Hilgers said the proclamations do not express a judgement on the validity of the measures.

They questioned the validity of the petitions under federal law and the Nebraska Constitution.
Under federal law, it is unlawful to either possess or sell marijuana.
Pillen and Hilgers said the measures cannot, and do not, change federal law.

Crista Eggers, the Nebraskans for Medical Marijuana campaign manager, said “the journey isn’t over” for those who need medical cannabis.
“While these measures are now law, patients must wait for the newly established regulatory commission to draft and implement the rules governing medical cannabis use,” she said. “For many, this delay will feel agonizing. But today’s victory is a reminder that progress is possible — and that the dream of accessible relief and healing for Nebraskans is closer than ever to becoming a reality.”
The Nebraska Supreme Court is taking up a lawsuit over allegations of fraud and improper notarization on the petitions.
And a judge in Lancaster County has yet to rule on a lawsuit challenging the constitutionality of the initiatives.
