HUNTSVILLE, Ala. (WAFF) – Alabama moves a step closer to medical marijuana in the state.
In a unanimous decision on Friday, a state appeals court determined a road block for issuing licenses to medical marijuana farmers, is now void.
After almost a year and a half of fighting a temporary restraining order, a civil appeals court ruled that it is now void.
Will Somerville represents Alabama Always, and when he first heard his case was dismissed, he was upset until he realized they got exactly what they wanted.
“I was in court, on another case, when I first got the dismissal notice. I was like ‘oh no this is terrible, my case just got dismissed,.’ When I read it I was like ‘this is great,’” said Somerville.
For almost a year and a half, Somerville has been fighting to keep the process moving for licensing medical marijuana farmers. A temporary restraining order has been in place, putting a roadblock in the way for issuing those licenses. Now that it has been lifted, the process can move along.
Joey Robertson is the president and CEO of Wagon Trail Med-Serv., he told WAFF he was happy with the court’s decision.
“It showed us with anonymous decision from the court that the restraining order that has kept us from moving forward and not allowed the patients of Alabama to have medication was never needed,” said Robertson.
Robertson told me this is just one step closer to making medical marijuana available to patients here in Alabama — nearly four years after Governor Ivey signed it into effect.
