[#item_full_content] The Supreme Court has agreed to hear an appeal of a ruling from the New Orleans-based Fifth Circuit Court of Appeals. The challenged decision says a law, 18 U.S.C. § 922(g)(3), is unconstitutional if it is applied to make gun ownership a felony if one merely smokes a joint, no matter whether the gun is even carried while under the influence. The Fifth Circuit is right: The law is unconstitutional.
