South Carolina’s long-time cannabis advocate Senator, Tom Davis, has launched a fresh effort to legalize medical cannabis in the state.
Last week (January 14), Davis reintroduced the ‘Compassionate Care Act’, or Senate Bill 53, which would create a licensed framework for cultivating, processing, and dispensing medical cannabis products.
Furthermore, 15 cultivation centres, 30 processing facilities, and 3 pharmacies per county would be licensed, with oversight falling under the Department of Public Health and Board of Pharmacy but local governments retaining the right to restrict operations within their jurisdictions.
While seeking to finally provide medical cannabis access in one of the US most strictest cannabis states, the proposals would also see very stringent regulations imposed on patients.
The bill prohibits home cultivation and smoking cannabis, allowing only vaporization, edibles, tinctures, and topicals.
It would also impose precise limits on patients level of consumption, including 1,600 milligrams THC for edibles and tinctures per 14 days, 8,200 milligrams THC for vaporization oils per 14 days and 4,000 milligrams THC for topicals per 14 days.
“This is a conservative bill because that’s what South Carolinians want,” Davis said. “It requires doctor authorization, supervision, and pharmacist dispensing.”
The 2025 bill excludes any tax provisions, avoiding constitutional hurdles that derailed earlier versions.
It also introduces a unique five-year sunset clause: the program would automatically terminate unless lawmakers vote to renew it based on a state-conducted survey of patients, caregivers, and stakeholders.
