SURFSIDE BEACH, S.C. (WPDE) — It has been almost one month since the Surfside Beach Police Department raided the store, Delta Dispensary, after a three-month-long, undercover investigation.

The owner of the dispensary, Jason Papotto, was charged with two counts of distribution of marijuana, as well as distribution of marijuana in close proximity to a school or park after illegal amounts of THC were found in his products.

Sabrena Papotto was also charged with one count of each of the above charges.

Since the investigation, the business license to run Delta Dispensary has been suspended, and by law, the Papottos have a chance to appeal that suspension.

On Thursday, Jason and Sabrena Papotto showed up to the special called meeting to appeal and avoid revocation of their business license.

An undercover officer who bought three times from the dispensary was the first to speak out as a witness to the town council.

The results came back as marijuana – it came back containing marijuana,” said Surfside Beach Police, Sergeant Pinto.

He said he went to the South Carolina Law Enforcement Division (SLED), to have them test the product.

He said SLED found the dispensary selling items three times higher in THC levels in their products than what is legal.

The legal amount of THC in a product in South Carolina is .3%.

Pinto said when SLED tested the Papotto’s products, they were found to be greater than one percent.

If anything comes back greater than one percent, that means that its at least three times higher than what it could be and classified as marijuana,” said Pinto.

Jason Papotto cross-examined Pinto’s argument and started to bring out products from other stores in Surfside Beach that he said are selling the same products.

They are selling the same bud, the same bud that we are selling,” said Papotto.

Papotto’s friends shared some of his worst fears when it came to the products he was selling.

Let me tell you, my testimony is that every single day when Jason and I talked, His number one fear was testing over,” said a friend of the Papotto’s.

The town unanimously sided with a business license official to revoke the dispensary’s license.

People get out into society and then they are openly carrying it or doing whatever with it, and then their subject to criminal consequences,” said Pinto.

The Papotto’s said these consequences are too far, and that they never meant to break the law.

We are not out to hurt nobody we have the least shady store in this whole town,” said Papotto.

The Papotto’s said they will be opening another dispensary, however, it will be outside of the Surfside Beach jurisdiction.

Pinto also said that SLED does give wiggle room for products testing a bit higher in THC content, but Papotto’s products were substantially higher in levels than what would be considered legal.

The investigation into the dispensary remains ongoing.
