LUBBOCK, TX — Senator Charles Perry, joined by Lt. Governor Dan Patrick, has announced plans to introduce legislation aimed at banning all consumable hemp products containing THC in Texas. Senator Perry will carry the bill, designated as Senate Bill 3 (SB 3), which reflects its high priority within the upcoming legislative session.
“The proliferation of unregulated, high-potency THC products is a growing threat to our communities,” said Perry. “These substances, often far more potent than illegal recreational marijuana, are easily accessible to young Texans, creating an unregulated mess that puts our families and children at risk.”
Lt. Governor Patrick emphasized the urgency of the legislation: “Senate Bill 3 will ban all forms of THC and keep these unsafe products off our streets. This is about protecting Texans from dangerous and mislabeled substances.”
SB 3 seeks to align with federal Farm Bill guidelines while addressing concerns about intoxicating and synthetic THC products. The proposed legislation maintains the legality of non-intoxicating consumable hemp products, such as CBD, provided they contain no detectable THC.
Crucially, SB 3 does not alter the state’s existing Compassionate Use Program (CUP), which allows regulated cannabis products for Texans with specific medical conditions under physician supervision. Instead, the legislation aims to focus on public safety while preserving access to medical cannabis for those in need.
“We must take bold action to keep dangerous drugs away from our communities and out of our schools,” Perry added. “Under Lt. Governor Patrick’s leadership, SB 3 will establish the toughest THC ban in the nation to protect the health and safety of our children and families.”
However, the proposed ban has sparked criticism, notably from Texas Agriculture Commissioner Sid Miller. Miller, a longtime advocate for Texas farmers, opposes the legislation, citing concerns over government overreach and the negative impact on the state’s burgeoning hemp industry.
“This bill undermines the hard work of our farmers and ignores the medical needs of many Texans,” Miller stated. “Not everyone is on the same page on criminalizing Delta-9 THC. The GOP needs to find consensus instead of running in opposite directions. We know what the polls say—it’s time to support the will of Texans.”
Miller also took to social media to voice his opposition, stating that legalizing medical THC aligns with the desires of the majority of Texans.
