The cannabis industry has long been plagued by confusing terminology—hemp, marijuana, cannabis, D9, and THC—terms that are often used interchangeably despite their distinct regulatory and scientific nuances. In Louisiana, this confusion is compounded by evolving laws and a rapidly growing market, especially for hemp-derived THC products. Recent tightening of regulations, along with the aftermath of the 2018 Farm Bill, has thrust Delta 9 products—primarily in edibles and beverages—into the spotlight.
Regulatory Clarity Amidst Growing Demand
State regulators have imposed limits on THC content in consumer products, and many states have banned synthetic cannabinoids that are not naturally occurring. As a result, only naturally derived cannabinoids like Delta 9 THC—the primary psychoactive component found in both hemp and marijuana—are legally used. This means that products containing minor cannabinoids, which must be synthesized to reach levels that produce euphoria or relaxation, face significant regulatory hurdles and have become less prevalent.
With the Farm Bill of 2018, major companies have begun to harness the potential of hemp-derived Delta 9 THC. Companies such as Cookies have partnered with New Orleans-based processing firm Fleur De Leaf, marking a significant milestone in the evolution of cannabis products. Cannabis giants like Tilray have also entered this fast-growing sector, which is projected to see over 23% growth in 2024, positioning hemp-derived Delta 9 THC products as a dominant force in the expanding cannabis market.
Demystifying Hemp Derived Delta 9 THC and Marijuana Derived Delta 9 THC: No Difference in Potency
A common misconception persists that Hemp Derived Delta 9 THC and Marijuana Derived Delta-9 THC differ in potency or effect. According to chemist and chemical engineer Annie Montelepre of Fleur de Leaf, “There is simply no difference between Hemp Derived Delta 9 and Marijuana Derived THC. When a liquid chromatography process is performed, the THC is separated and demonstrates a potency similar to that found in Marijuana-Derived THC.” In essence, Delta 9 is the psychoactive component responsible for the “high” experienced with cannabis—without it, there would be no euphoria. Comparing Hemp Derived Delta 9 THC to Marijuana Derived Delta 9 THC is like comparing the citrus content of an orange to that of a lemon; the potency isn’t diminished—it just requires processing more raw material to extract the same active compound.
New Market Dynamics in Louisiana
Under new Louisiana laws and restrictions, THC-infused edibles are no longer available in gas stations. Instead, these products are now sold in major grocery stores, minimarts, liquor stores, and smoke shops across the state. In addition, a new emergency rule, effective April 5, mandates that only a Louisiana manufacturer/processor license holder can register THC products in the state. Out-of-state companies must now partner with a licensed processor – such as Fleur De Leaf – to access the Louisiana market.
Fleur De Leaf’s formulator and owner explains, “Many companies from across the country have reached out to us to sponsor their company and register their products for Louisiana with the LDH and ATC. For manufacturers who have been operating for six years and consistently paying taxes, this presents a unique opportunity to capitalize by aligning with reputable, publicly traded cannabis brands. For local companies like Fleur De Leaf, it creates a significant advantage in an evolving market where, increasingly, out-of-state players must partner locally.”
As the market stabilizes, many states are adopting guidelines similar to those established in the marijuana industry as well as the alcohol and liquor distribution sectors, further validating the regulatory framework now in place.
The Bottom Line
In Louisiana, the distinctions between Delta 9 and THC are now clearer than ever: they are essentially the same, with Delta 9 serving as the psychoactive element that defines the cannabis experience. As the legal and scientific landscapes continue to evolve, understanding these nuances is crucial for both consumers and industry stakeholders. With robust growth, strategic partnerships, and a favorable regulatory environment on the horizon, Louisiana’s cannabis market is poised to lead the charge in redefining recreational and wellness products for years to come.
