Virginia can maintain a statewide ban against hemp products that contain a certain concentration of THC, a federal appeals court said Tuesday.
Affirming a trial court’s order favoring Virginia, the US Court of Appeals for the Fourth Circuit said the hemp ban doesn’t conflict with the 2018 Farm Bill, a federal piece of legislation that loosened restrictions against hemp.
Congress in excluding hemp from the definition of marijuana “expressly permitted states to regulate the production of hemp in a manner more stringent than what is set forth” in the federal law, the appeals court said.
