WILSON — The developer of a cannabis cultivation and distribution facility will once again be pitching his proposed business operations to village officials.

Tom Maxwell wants to open an indoor growing facility for recreational marijuana, Northern Lights of Niagara, at the site of the former Hamilton and Clark Funeral Home, 268 Young St.

Maxwell will appear in front of the village Zoning Board of Appeals on Thursday to seek a special use permit.

Maxwell said that he has been in the process of trying to open a cannabis business in the village for several years. He most recently appeared in front of the village’s now-defunct planning board in March and June respectively.

“Initially, we applied for a use variance, but then they said that (I) should go for a special use permit. They were almost ready to grant it, and then things changed, and they decided to send it to (the zoning board),” Maxwell said.

Shortly after Maxwell appeared in front of the planning board in June, he received approval for the license.

He believes that having climbed that hurdle, he should be able to obtain the permit from the village and would soon begin work to get the building in shape to host the business.

“I think they’re all on the same page, but we’ll wait and see what happens. Nothing’s been decided yet,” Maxwell said.

While the village ultimately decided to “opt-in” to host cannabis dispensaries in December 2021, some village officials said they were still left with more questions than answers about regulating such facilities at the local level, much like they were two years ago. The Town of Wilson had opted out of hosting cannabis dispensaries that same year.

“By not opting out, it left the doors open to figure out what would be best for the village down the road,” former village Trustee Brad Simpson told the Union-Sun & Journal in March. “Even now, we just don’t know what things are looking like and what laws are coming into play around the creation of places whether it’s for cultivation or dispensaries.”
